The session commenced at 12 noon with a short introductory note by Ms. Madhura Vaidya (Convenor, CCADR) wherein she welcomed the guest speaker Mr. Akash Gupta (Lecturer, JGLS, Arbitrator & Conciliator).
Mr. Gupta set about the lecture by briefly explaining ADR and arbitration in particular. It was followed by an example through which he described that the courts have “supervisory jurisdiction” and a “supportive role” in an arbitration proceeding. Then, he highlighted certain sections of the Arbitration and Conciliation Act, of 1996, dealing with the circumstances under which judicial intervention in an arbitrary process is possible. He also pointed out various provisions of the UNCITRAL Model Law on ICA concerning the topic. He further cited some landmark judgements discussing which matters are arbitrable and which are not and the jurisdictions of the courts in different matters.
Mr. Gupta kept the lecture interactive by asking the views of the participants on the matter from time to time. The lecture came to an end with a series of questions from the participants.
The ceremony ended with a warm vote of thanks given by Ms. Dakshita Dubey, a student member of CCADR. The session was attended by over 100 students from different universities.
